Grant 0 Reviews Vantage Press, 1984 160 pages How McDonald’s tracks morale at the front line A successful engagement effort should result in happier customers Mark Blundell Mark Blundell started work in McDonald’s in 1985 and has gained experience working at all levels in the retail arm of the business. He has recently become head of HR Operations within the organization. Like most retail organizations, McDonald’s is well aware that a drop in engagement at the front line is likely to have an impact on customer service. So the company has a number of initiatives in place to motivate employees and build loyalty. Here, Mark Blundell describes the approach used to monitor the impact of its engagement efforts. Following my presentation at Melcrum’s Annual Employee Engagement conference in London in May 2007, I was asked many questions about the way we measure the impact of the recent employee engagement initiatives at McDonald’s. In broad terms, we use three categories of measurement: employee surveys, third-party review and operational outcomes. Employee surveys The McDonald’s â€Å"Your Viewpoint† survey is a long-term tracking study of employee opinion. It’s been conducted on a global scale for many years with ORC International, who provide an independent assessment of the results in every country in which we operate. A UK participation rate of 83 percent in 2006 demonstrates that it’s something everyone in the business takes very seriously. The data is analyzed and cut to mirror the structure of our organization in terms of job â€Å"families† (e. g. , hourly-paid restaurant staff, restaurant management, office staff, etc. ) and geographically, from national level right down to the level of the individual restaurant. The survey consists of 50 statements which cover five recognized drivers of commitment. Employees respond to these statements with a simple â€Å"agree†, â€Å"neutral† or â€Å"disagree†. In 2006 the results from our UK hourly-paid employees were as follows: Development and personal growth: 85 percent agree. Resources to get the job done: 82 percent agree. Values and leadership behaviors: 84 percent agree. Competitive pay and benefits: 77 percent agree. Respect and recognition: 80 percent agree. Although these results aren’t perfect they are, I think, better than many people assume McDonald’s would achieve. Third-party review We also regularly open our doors to tho se who would like to undertake a serious, objective study of our business and in recent years have welcomed Investors in People, the Work Foundation and the Great Places to Work Institute among others. Last year we gave Professor Adrian Furnham of University College London unrestricted access to our managers and crew to study the impact of working at McDonald’s on our employees. Regarding employee engagement he concluded the following: â€Å"Overall, McDonald’s staff felt good about themselves, experienced strong job satisfaction and had exceptionally high engagement levels. Indeed, nearly every staff member interviewed could be counted as engaged, whereas the typical figure is substantially lower. † Operational outcomes The McDonald’s business model is a simple People-Profit chain: engaged people delivering quality products and great service in a clean environment create loyal customers. Customer loyalty, in turn, drives sales and profitability. If we’re succeeding in engaging our employees we should be seeing a measurable impact in our mystery-shopper surveys. These assess quality, service and cleanliness in our restaurants – results of which are fed into a â€Å"People Scorecard†, which details annual performance data for the last five years, alongside quarterly data and targets for the current year. In addition, the People Scorecard presents snapshot data of staff perceptions and, as an inverse measure of customer satisfaction, information about complaints we’ve received. This data can also be analyzed by every manager in our business to clearly see how employee engagement influences our overall performance. Data that makes a difference By knowing which managers are creating a great place for their employees to work, we’re able to celebrate and reward individual excellence. And by knowing which restaurants are achieving the best mystery shopper results we can reward the whole team too. On the other hand, where performance isn’t what it should be, the depth of the data means that we can focus on the areas of a particular store that need support without condemning everything that’s happening there. So, any intervention we make can be positive, supportive and evidence-based rather than being critical, demoralizing and subjectively judgmental. Again, McDonald’s isn’t perfect, but we believe that by gathering and analyzing engagement data from a range of sources, we’re able to pinpoint exactly where our imperfections can be found. Amid the beeping and buzzing of fry timers, Travis at any given moment is voiding orders at the register, handing out cups for drinks, wiping trays, or stuffing toys into Happy Meal boxes. If only the fast-food titan could get more people like her to run its 6,700 company-owned restaurants. While an average McDonalds grosses $2. 2 million a year, seasoned managers who motivate employees and keep customers coming back can add more than $200,000 to that total. Restaurant managers are in the most important position in our company, says Richard Floersch, McDonalds chief human resources officer. Yet despite generous salaries - up to $62,000 plus bonus and company car, say insiders - turnover is a constant concern in an industry that typically sees 43 percent of its staff leave each year. To stanch the bleeding of valuable talent, McDonalds in 2004 began offering a rich retirement savings perk. Employees who put 5 percent of their salary in the company 401(k) receive a company match of as much as 11 percent, turbocharging their savings right off the bat. To make sure employees take advantage of the program, McDonalds has made enrollment automatic. And to ease the pain of automatically deferring 1 percent of pay, the company gave managers a one-time, 1 percent salary increase. But persuading prized employees that the benefit is reason enough to stay with McDonalds for the long term is an ongoing challenge. Skepticism about investing runs especially high among African Americans, who make up 15 percent of the companys manager pool. Research shows that blacks, in the aggregate, are reluctant to save. According to a 2008 study by Ariel Investments and Charles Schwab, blacks save an average of $169 a month for retirement, while comparable whites (in terms of household income) contribute about $249 a month. Race and ethnicity trump gender - and even salary - in the factors that predict whether a person will save for retirement. Preparing for the future Why dont blacks save more? The reasons are complex, but the underlying theme is cultural. African Americans are distrustful of the financial system because it has excluded them for generations, says Andres Tapia, chief diversity officer at Hewitt Associates, the benefits-consulting giant. Hewitts research shows that African Americans consistently put home ownership and college ahead of retirement goals. Owning a home and educating children become a huge priority, explains Tapia, if you are the first person in your family to do it. Preparing for the future can also be controversial in the black community. If your mama lives with you - and others in your extended community are struggling to get by - putting aside money that you cant touch for the next 15 to 20 years feels selfish and inappropriate, Tapia says. Indeed, for many blacks, retirement is more a dream than a priority. The Ariel-Schwab survey found that African Americans under the age of 50 are nearly twice as likely as comparable whites to say they want to retire by 60, but they are half as likely to cite retirement as their most important savings goal. Adding to the skepticism, the great market meltdown of 2008 showed that even the most carefully crafted retirement plans can be ruined by forces beyond a persons control. This is a big setback that will affect all people, says Mellody Hobson, president of Ariel, the largest African American-run money manager. In our community, which has had less exposure to the market, people are especially nervous about investing. Such reticence has made McDonalds efforts to sell its perk to employees all the more difficult. Generous inducements to save Few employers offer 401(k) plans as lavish as the one at McDonalds. In fact, many companies have been cutting back on their matching contributions in recent months as the recession deepens. McDonalds corporate matc h is especially extravagant at lower levels of saving: employees who put just 1 percent of their salary in the plan get $3 for every $1 they invest. Most companies wont even match a contribution until an employee puts in at least 3 percent. ) McDonalds then makes a dollar-for-dollar match on the next 4 percent. After that theres a potential profit-sharing match of up to 4 percent. All told, workers who save 5 percent of their pay can see the total swell to 16 percent. But corporate 401(k) plans arent an if-you-build-it-they-will-come kind of benefit. Companies can send out pamphlets, but the burden of persuading employees that the plans are orthwhile ultimately falls on people like Kenny Sanders, who heads human resources for the Heartland region of McDonalds, overseeing 76 company-owned stores. Like Travis, Sanders, 44, started working at McDonalds in St. Louis when he was a teenager. Over the past 28 years he has risen through the ranks beyond store manager to corporate management. McDonalds crew members dont sit in front of computers all day, leaving little opportunity to check 401(k) balances or make tweaks to asset allocation plans at work. So Sanders spends much of his time out in the field talking to employees about their financial future. My goal is to get people to understand that this is more than a job. You can put away a nice nest egg for you and your family, depending on how long you stay at this company, Sanders says. Looking beyond paycheck to paycheck Sanders main goal is to keep people like Travis, who oversees one of the St. Louis areas most profitable McDonalds restaurants, interested in saving. Everything Travis knows about building a nest egg she learned at McDonalds - most of it gleaned during the four years since the retirement program began. Before t hat, I didnt realize that putting money in the bank and saving for retirement is not the same thing, she says. Its a real eye-opener to learn that McDonalds will match what you put in, Travis says. It helps relieve a lot of stress. Sanders was the first person Travis turned to for investment advice when she looked at her September retirement account statement and saw that her balance was down almost $11,000 for the year. Sanders recalls assuring her. You lose a little here, and then you gain a little there. Saving for the future has been a luxury that Travis, 47, could not afford until recently. For most of her life the divorced mother of two was just making ends meet, she says. Travis had her son, Lamar, at 20. Her daughter, Latisha, came along when she was 29. Buying a home, paying for braces, helping her elderly parents with living expenses - all those things derailed her plans to save for the future. I know you have to have a security blanket, but I was living paycheck to paycheck when I had my first baby, Travis says. Thats why Travis connects so well with Ebony Henderson, a second assistant manager at the same McDonalds, who gave birth to a boy named Jeremiyah in August and has a toddler son named Quian Jr. We each had babies young, Travis says. But Im not about collecting money from the state. Im a person who wants to make money and keep stability. Thats how Ebony seems to me. When Henderson, 26, joined McDonalds at age 15 to earn money for school supplies and clothes, she never thought it would be a serious career path. Today she eyes the golden rung of store manag er and plans to start the interview process this month. Im doing good now, but I want to be where Sadies at in the future, says Henderson, whose tinted hair matches her red cable-knit sweater. I dont want to be working all my life with nothing to show for it. Despite the market downturn, Travis says she remains on track for retirement. Shes confident shell be able to leave the work force in 10 to 15 years with a $200,000 nest egg. I dont want to shoot for a million, she says. I dont want to be greedy. Others arent so sure about the future. Since the stock market began to unravel last fall, Sanders says, more than 100 employees have asked him for investment guidance, often brandishing their retirement account statements. Im not an adviser, so I cant really tell them what to do, Sanders says. He looks over statements to make sure employees are well diversified and usually recommends the financial advisory services McDonalds offers to employees. But I always say that staying the course is the right thing for me, he says. Amid the market turmoil, its more important than ever for Sanders to reach out to workers. After all, he says, Whats good for employees is good for McDonal ds.

I’ll explain the various strategies you can use, and then go over how to decide which one is the right one for you. 4Key SAT Study Strategies No matter what SAT score you're shooting for or how you plan to get there, here are the strategies you absolutely must employ to raise your score. #1: Determine Your Target Score Before you begin your SAT studying, you'll need tofigure out what score you’re trying to get on the SAT.Having a target score will motivate you and inform your studying. To findyour target score, look up the 75th percentile SAT scores for the schools you’re planning to apply to. Don’t include your safety schools- instead,only look up the scores for the schools you’re most interested in attending. The easiest way to find SAT score info is to Google â€Å"[School Name] PrepScholar SAT† and look for your school's "Admission Requirements" page in our database. This page will tell you that school's average, 25th percentile, and 75th percentile SAT scores. (If you take a practice test, be sure to simulate real testing conditions as closely as possible!) Here’s an estimated breakdown of the point improvements you can expect for various numbers of study hours: 0-30 point improvement: 10 hours 30-70 point improvement: 20 hours 70-130 point improvement: 40 hours 130-200 point improvement: 80 hours 200-330 point improvement: 150 hours+ Once you know how long you'll need to study, you can make a plan that'll let you put in enough study hours and ultimately hit your goal score on test day. By determining the specific question types you’re getting wrong, you can identify the topics you need to study more. For example, maybe you’re struggling with punctuation questions on Writing. Or perhaps you’ve been missing the small number oftrigonometry questions on Math because you never learned SOHCAHTOA. As soon as you know the topics that are most challenging for you, you can use your study time to understand them better and do a ton of related practice questions in order to improve your weaknesses. Time The SAT is a strictly timed test, and even if you’re comfortable with the content, you might struggle finishing each section in time. If you’re somebody who either rushes (you finish a section more than five minutes early and make careless mistakes) or struggles to complete a section within the allotted time, you’ll need to work on your time management. Strategy The SAT is known for having questions that can be confusing or misleading. If you struggle with understanding what a question is asking or often fall prey to common SAT tricks, you’ll benefit from improving your knowledge of SAT strategy. For example, if you understand how to do all the math on the Math section but have difficulty interpreting the wording in certain questions, you should spend more time learning how to figure out what the questions are really asking. If you're missing Writing questions because you're not sure how to read the passages, that's another sign you need to change and improve your strategy. More generally, you're having problems with strategy if you can grasp the content being tested but struggle to understand and approach SAT questions. #4: Use Realistic Practice Questions and Tests Undoubtedly, the best questions to use are those that most closely resemble the questions on the SAT. A huge flaw of many SAT prep books is that their practice questions aren’t exactly like those on the test. They’re either too difficult, too simple, or presented in a way that differs from the usual SAT question format. It won't help your SAT score much to focus on questions not like those you’ll encounter on the SAT. Therefore,you should use the eight official practice tests provided by the College Board. Khan Academy, a free website that haspartnered with the College Board, is also a good source of official SAT practice questions. Other options for realistic questions areofficial PSAT practice tests(though these will likely be slightly easier than actual SAT questions). Finally, because ACT Reading and ACT English are now so similar to SAT Reading and SAT Writing, you can use official ACT practice tests to supplement your Reading and Writing practice. How Should You Study for the SAT? 4 Methods Now that you know the strategies you must employ to study for the SAT, I’ll go through the various options for SAT studying to help you determine the best method for you. Method 1: Self-Study It’s possible to reach your target score by studying entirely on your own. Whether you've chosen to study independently or simply don’t have the resources to pursue other options,effective self-studying will require you to be extremely disciplined, organized, and motivated. You should set a definitive study plan and stick to it as closely as possible. Other than real practice tests and SAT prep books,I highly recommend reading our SAT blog to further guide your studying. We've written tons of content and strategy guides for the Reading, Writing, Math, and Essay sections. A major drawback of just relying on real practice questions or Khan Academy to study is that you won’t learn test strategies. These strategies, which are explained in our articles, will simplify the test and can help you improve your score. Method 2: Private Tutor A private tutor might be a good option for you if you’re looking for customized instruction or need more help learning the material that’s tested on the SAT. Also, meeting with a tutor can help you stay on track if you need a little push. Keep in mind that tutors can be expensive and oftenvary greatly in terms of their knowledge and effectiveness. Before hiring a tutor, learn what SAT tutors do and how much they cost. Equip yourself with the knowledge to decide whether you should work with a tutor or on your own. Method 3: In-Person SAT Prep Class In-person prep classes have a set curriculum, and, like tutoring, they’re a good option if you need help sticking to a study plan. A prep class can be a good fit for you if you want to learn test strategies and increase your familiarity with the SAT. The best SAT classes willgive you a solid foundation in SAT material and help you study more effectively on your own.Additionally, if you feel that you learn better in a traditional classroom setting, you might enjoy being able to socially interact with your peers. Prep classes do have some significant drawbacks, though. In my opinion, the biggest drawback of a class is that it's not customized to your individual needs.Classes often have students of varying skill levels, and much of its content might feel like review or, on the contrary, might be too challenging if you've never been exposed to the material before. I've taught a number of SAT prep classes, and, as a teacher, my biggest challenge was always trying to make my classes helpful for each student. In the same class, I had students who had just learned English and students who were excelling in their AP English classes. While students at every level did see improvement in their SAT scores after taking my class, admittedlyit was impossible for me to perfectly address the needs of every student. Depending on the length of the course, you might not have enough time to thoroughly cover all of the material on the SAT. Furthermore, SAT classes can get expensive, with many costing more than $1,000. Method 4: Online SAT Prep Course Online prep courses can be a great option for students who want some structure but also the freedom to work independently.The biggest advantages of a good online prep course are that you’ll get an effective study plan and thorough content instruction. Secondly, some students just learn better with an instructor in front of them who can immediately answer their questions and provide them with further explanation. While a quality teacher or tutor can keep you engaged with material you might not find too exciting, an online course can feel a bit distant and boring. Although I think spending money on SAT prep is a worthy investment, some students simply can’t afford a tutor or prep course. If you want to take a prep course but don't have enough money, talk toyour school counselor or look online to see whether there are any free SAT prep courses available in your area. In my own experience,I’ve taught several free SAT classes through organizations that specifically cater to low-income students. #2: How Do You Learn Best? Personally, I’ve always preferred studying independently. In school, I learned better reading alone from a textbook than I did in class listening to my teacher lecture. So ask yourself:which of the SAT study options above will work best for your learning style? Remember that you can combine study options, too. For example, you could primarily self-study and then hire a tutor for a couple of hours to help you understand a concept that's been puzzling you. Or, you could take an in-person prep course to learn test strategies and then take an online course for further content instruction. #3: Will You Be Able to Stick to a Study Plan? Self-studying and online courses work best for the most disciplined and determined students who are able to stay on task without the help of an instructor. However, even if you take a class or hire a tutor, you need to staymotivatedto be able to do the necessary work to reach your goal score. Consider your own study habits, such as how often you tend to procrastinate, and then choose the method that'll best suit your prep needs. #4: How Much Guidance Will You Need? If you're only around 50 points away from your target score, you might be able to reach your goal with a couple of weekends of self-studying or a short in-person prep course. However, if you need to raise your score by a large number of points- say, 300 points or more- and you’re struggling to understand critical SAT concepts, you'd probably benefit from more intensive instruction, such asfrom a tutor, online prep course, or multi-week class. However it also created problems in American society. There are several advantages and disadvantages to industrialization. The Vietnam War established the book as an anti-war classic because of the war’s paradoxical nature. Heller perceives war as a no win situation. The book elaborates on the sane and the insane ways of the nation. The question is who is to determine the insane? It all comes back to the paradox that 'Catch-22' delivers. The trauma this book illustrates threatens the government’s ideal of peace. There was a time when Heller’s classic satire on the murderous insanity of war was nothing less than a rite of passage. Throughout the book it reveals a portrait of war that is the reality. The sarcasm and structure of this novel is Heller’s way to show the actuality of war’s dispair. The author exemplifies war as trivial; his characters are not fighting the enemy, but they are fighting within themselves. The world has known war ever since the beginning of time, but time has to change if the nation is going to prosper in a positive direction. In Catch-22 most of the sane characters put all of their time and energy into getting home. Intolerance from The Crucible Essay

Ayn Rand once said â€Å"A single lie destroys a whole reputation of integrity. It means that a lie sadly has enough power to cause corruption in a society. It also suggests that a lie perhaps be strong enough to destroy even a high ranking person from a society. If you tolerate lies dominating people around you, you’ll eventually be a victim of them. Two literature works that explain this quote are Author Miller’s play, The Crucible, which takes place in a Puritan town named Salem in the state of Massachusetts during the year of 1692. The Crucible shows how intolerance corrupts the town. And Maurice Ogden’s Poem, â€Å"The Hangman,† which takes place in an unnamed town. â€Å"The Hangman† shows how the ignorance of the townsfolk gives a pathway to the Hangman which enabled to execute every single one of the townsfolk on his gallows-tree. Meanwhile intolerance also takes place in â€Å"The Hangman† which makes the Hangman has no mercy for people who questioning him. Both literatures works The Crucible and â€Å"The Hangman† have Intolerance as one of the main themes in common. Intolerance takes place in â€Å"The Hangman†. The Hangman gives the townsfolk a severe test, which is the hang trial and see how the townsfolk will address it. The Hangman nervously arrives in the reader’s unnamed town, and built his frame. The town folks are wondering who the criminal is and what the crimes are. On the very first day he hanged a man who came from another land. The townsfolk who gathered in the courthouse square, leaves without saying anything because they don’t care for the foreigner. The townsfolk believed that the frame would be gone by the next day, but it didn’t because they neglected the first hanging. Now the Hangman doesn’t even bother to do so, because the townsfolk showed him they don’t really care. For the reason of that, the townsfolk become such easy targets for the hangman, because of his intolerant attitude. The Hangman’s intolerant personality combined with the townsfolk ignorance lead the hangman to executing the townsfolk in a large amount, which happens clearly because of ignorance. Those who wander why were hanged. This causes the town’s residents to become fearful. Then more and more were hanging. Finally even the speaker of the poem was hanged because of his ignorant personality. This means anyone who neglect either a party or someone dominate them will eventually suffer of it. Maurice Ogden Intolerance takes place in The Crucible It all began with a Negro slave named Tituba, combined with a group of daft girls goes dancing in the forest. In a Puritan town, anything that’s look unfamiliar to the Bible consider as something against it. While dancing in the forest, the girls ironically caught, by the town’s minister, Reverend Parris. On the following morning both Parris’s and the Putnam’s daughter were unable to wake up. The Villagers gathers at the minister’s house and quickly witchcraft rumor invade the town. Abigail what was a part of the girls dancing and who is Parris’s niece, warns the others girls to not to admit what they were doing in the forest. She even menace them she could kill them if they do so. Parris is paranoid; he believes that his congregation should not lift a finger without his permission when church is in motion. He thinks of nothing to do but to put his slave under pressure, because he think that Totuba might do witchcraft on his daughter, Tituba says to Parris â€Å"My Betty be hearty soon.† (Miller 8) This quotation shows that Intolerance has taken place in The Crucible Because Parris is don’t want his daughter to die, questioning and punishing Tituba is a good way to be aware of what actually happened in the forest. Another way in which intolerance has taken place in The Crucible is when Tituba fearfully accuses several town folks of reading the devil book. Abigail joins her revealing that she has seen many women with the devil. Betty and the other girls joining them as well, and they start pointing their finger on people. Abigail says â€Å"I want to open myself. I want the light of God, I want the sweet love of Jesus! I kiss his hand. I saw Good with the Devil! I saw Goody Osborn with the devil! I saw Bishop with the Devil.† (Miller 48) This quotation tells that she is showing the villagers that she want to be a better Puritan, she want to show the authorities that she is not a witch indeed she is. All of her accusers were hanged by the end of the story, Except Sarah Good who confessed right away. The fact that they hanged the accusers shows zero tolerance for witchcraft, they hanged the accusers because a puritan society does not tolerate witchcraft and that morality is obviously tradi tional. Another way in which intolerance has taking place in The Crucible is when Abigail who had an affair with John Proctor profits the witch trial occasion to accuse John’s wife of witchcraft so she could win it all. When Elizabeth name had been called in court john reveal that He had an affair with Abigail to test John’s claim judge Danforth approached Elizabeth and ask her if Proctor had been unfaithful to her, she lies to Proctor’s honor and judge Danforth denounces Proctor as a liar. Abigail herself forced Proctor’s servant to accuse him of being a witch, and she who is already afraid of her does so. Proctor says to Mary Warren â€Å"Do that which is good and, no harm shall come to thee.†(Miller 95) This quotation shows how Proctor is praying his servant to tell the truth; although she has great conscious she doesn’t do so because she is afraid that Abigail can attack her in her sleep. Proctor is rages not only against the court but also her, and now proctor is arrested. This suggest intolerance because, if intolerance wasn’t present they would have listen to Proctor’s argument too which have great integrity in the town, but because of intolerance they’ll hang him as any other accusers if he do not confess of witchcraft. In brief, both the poem, and the play speaks of intolerance, although â€Å"The Hangman† is mostly based on ignorance. It’s clearly has shown by the beginning of the poem that the townsfolk shows that they would not tolerate the Hangman to kill anybody in the town, but furthermore they ignore the Hangman, which they shouldn’t do because the greatest ignorance is to reject something you don’t know. They play, The Crucible shows that Salem won’t corrupt if there was tolerance, unfortunately it does, and later on the Judges discovered that they weren’t doing the correct thing but it was way too late due to the number on people died.

The Computer Crime Law in Ireland

Criminal law varies in different countries and temp to deal with computer–related crime. Due to the ever-changing and the sophisticated form of information technology, new type of computer crime surfaces everyday and is threatening the functionality of the system as an asset of a borderless information society. In order to manage and protect this vibrant digital age, new legislation is also put in place to combat these crimes. The existing laws might have been suitable for the old traditional computer crime; the use of a mobile device to denial your keylogg access to your car may have no legal reference in any formal computer crime law. This paper will point out some of the known legislations that exist in Ireland and the EU relating to computer crime, and the awareness in a computer forensic discipline. Introduction With the vast amount of business documents being written on computers, the popular use of email, transaction of business on the internet, computer keep most civil litigation evidence that exist in our present day. It is unimaginable for any business of a sizable scale to function properly, these days, without the use of computer or any form of computing device. Unfortunately, what was designed to help solve almost all problem that exist, (being social networking, e-commerce, entertainment, personal dairy, communication), is posing a great threat to the society that should benefit from it. Imagine a company that buys used cars online and re-sell them to make profits, provides its employees with fast internet access. An employer search through the usual websites and found an interesting car at cheap price, instead of doing the transaction unbehalf of the company, he bought the car for himself. The manager saw him with the car the next day and raised suspicion. He then consulted a forensic investigator to handle the case. Special procedures may have to be carried out during a computer forensic investigation in order that any information gathered is eligible for use in a court of law. The investigation revealed that he used his account to log on to the work computer for the deal during working hours. The investigator found something else, a child pornographic material on his computer. Is this a computer crime? r an abuse of company’s policy? , or something else?. Would the evidence found by an investigator contracted to do one job but did more be accepted in the court, if indicted? Would the Irish Data Protection Act of 1988 protect his secret from prosecution? or face Child Traffic and Pornographic Act 1998? Due to the fact that computer crime is generally new, specialized legislation is in place for some computer and digital specific criminal behaviour, and forensic investigators should be aware of this. The Irish Computer Crime Law The Irish Legislations that are relevant in the area of computer crime are the Criminal Damage Act, 1991, and the recent Criminal Justice (Theft and Fraud Offences) Act, 2001. The Criminal Damage Act, 1991, Section 2(1) introduced the offence of damage to property, defined as – â€Å"a person who without lawful excuse damages any property belonging to another intending to damage any such property or being reckless as to whether any such property should be damaged is guilty of an offence†. Property includes data and damage to data includes the addition, alteration, corruption, erasure, or movement thereof, or introduction of a virus therein, which causes damage. It shall be noted that the offence requires the absence of â€Å"lawful excuse† and, in addition, requires the accused to act with intent or recklessness. Summary conviction or on indictment carries different penalties. On summary conviction the penalties are a fine of up to â‚ ¬1,270 or imprisonment for up to 12 months, while on indictment; the penalties are a fine of up to â‚ ¬12,700 or imprisonment for up to 10 years, or both. The 1991 Act introduced a range of offences. Section 3 of the 1991 Act introduced the offence of threatening to damage property and Section 4 introduced the offence of possession of any thing with intent to damage property. Both carry the same penalties as a Section 2 offence Section 5 then introduced the offence of operation of a computer with intent to access data without lawful excuse. The offence is efined as – â€Å"a person who without lawful excuse operates a computer within the State with intent to access any data kept either within or outside the State, or outside the State with intent to access any data within the State, shall whether or not he accesses any data, be guilty of an offence†. The penalties on a conviction offender are a fine of up to â‚ ¬634, or imprisonment for up to 3 months. The recent update in Irish legislation, regarding computer-related crime in Ireland extends the previous Act and introduced the Criminal Justice (Theft and Fraud) Offenc es Act, 2001. The 2001 Act introduced various new offences into Irish law, most importantly, the Act which appear under Section 9. Section 9 states – â€Å"a person who dishonestly, whether within or outside the State, operates or causes to be operated a computer within the State with the intention of making a gain for himself or herself or another, or of causing loss to another, is guilty of an offence†. This section introduced the concept of â€Å"dishonesty† into Irish computer related crime. The offender can be located either inside or outside the State and is required to act dishonestly, meaning â€Å"without a claim of right made in good faith†. The operation of a â€Å"computer† is required. The ever-increasing development of technology available to commit crime over the internet requires international co-operation beyond ordinary domestic legislation. Section 9 of the 2001 Act, which aim at a person, â€Å"whether within or outside the State†, point out the possibility of jurisdictional issues that comes up, and has allowed the courts to try an offender irrespective of their location at the relevant time. operates† physical machine must be operated from the state or cause to be operated; doesn’t require physical control of the machine, can be remotely controlled outside of the state. Privacy and Data Protection Even if the Irish Constitution of 1937 does not clearly state the right to privacy, in the Kennedy & Arnold v Ireland [1987] IR 587, the Irish court recognised the existence of this law. Article 8 of the European Convention on Human Rights provides that: †¢ Everyone has the right to respect for his private and family life, his home and correspondence. †¢ There shall be no interference by a public authority with the exercise of this right except such as is in accordance with the law and is necessary in a democratic society in the interests of national security, public safety or the economic well being of the country, for the prevention of disorder or crime, for the protection of health or morals, or for the protection of the rights and freedoms of others. The Irish Data Protection Act 1988 was passed on 13 July 1988, and implemented on 19 April 1989. This Act established the Irish Data Protection Commission. The Irish legislation was updated in 2003 by the Data Protection (Amendment) Act, which incorporates Directive 95/46/EC into Irish law. The law means Data protection is about your fundamental right to privacy. You may access and correct data about yourself, but those who keep data about you have to comply with Data Protection Act. An individual or an organisation that collects stores or processes any data about living people on any type of computer or in a structured filing digital system, found guilty of an offence under the Acts can be fined amounts up to â‚ ¬100,000, on conviction on indictment and/or may be ordered to delete all or part of the database.
